High Court Greenlights KDF Deployment Amid Controversy Over Anti-Finance Bill Protests



In a landmark decision amidst national uproar, the High Court has approved the deployment of Kenya Defence Forces (KDF) following intense protests triggered by the controversial Finance Bill on June 25. Judge Lawrence Mugambi's ruling, delivered during a technically challenged virtual session, underscores the need to safeguard public safety and protect critical infrastructure.


Judge Mugambi acknowledged the necessity of military intervention but stressed the importance of transparency in the deployment's terms and duration. He expressed concerns about potential militarization and its impact on civil liberties, urging clarity to prevent public mistrust.


The Law Society of Kenya (LSK), which filed the petition, argued that the deployment lacked legal grounding without a declared state of emergency. LSK President Faith Odhiambo contested the timing of parliamentary approval, claiming it followed the gazettement, breaching procedural norms.


Government spokespersons, including Attorney General Justin Muturi, defended the deployment's legality, asserting adherence to due process in gazetting military assistance.


The court's decision includes provisions for monitoring potential rights violations during the deployment, balancing security imperatives with constitutional rights.
