High Court Halts Senate's Decision to Impeach Meru Governor Kawira Mwangaza Amid Constitutional Challenge

In a dramatic turn of events, the High Court in Milimani, Nairobi, has temporarily blocked the Senate's decision to impeach Meru Governor Kawira Mwangaza. The court’s ruling, delivered on August 21, 2024, underscores the gravity of the situation and raises significant constitutional questions about the balance of power and due process in the impeachment of elected officials.

Governor Mwangaza, who faced impeachment by the Senate just a day before, swiftly moved to challenge her removal, filing an urgent application that prompted the court to intervene. The High Court, recognizing the "constitutional, legal, and factual issues" presented, suspended the Senate's resolution, effectively reinstating the Governor pending further legal proceedings.

In a bold move, the court also restrained the Senate Speaker and any other authority from declaring the Governor’s office vacant in the Kenya Gazette—a critical step in the formalization of impeachment. This decision is seen as a significant legal victory for Mwangaza and her supporters, signaling a potentially precedent-setting battle over the limits of the Senate's powers.

The court has fast-tracked the case, with strict deadlines for the involved parties. The Senate must respond by August 28, 2024, followed by Governor Mwangaza's rejoinder on September 4, 2024. The final submissions are expected by mid-September, with the next court mention set for September 17, 2024.

This legal battle is being closely watched, as it could have far-reaching implications for the political landscape in Kenya. The High Court's penal notice warns of severe consequences for any disobedience of its orders, highlighting the seriousness of the matter. As the legal process unfolds, the nation is left in suspense, awaiting the final outcome of this high-stakes confrontation between the judiciary and the legislative branch.
