High Court Stops Gachagua replacement process

The High Court has suspended the Senate resolution to uphold the impeachment motion against former Deputy President Rigathi Gachagua, which was conducted on Thursday, October 17. This ruling, delivered by Justice Chacha Mwita on Friday, October 18, underscores the legal complexities and public interest surrounding Gachagua's case.
Justice Mwita noted that Gachagua's petition raised significant issues of law and public interest. He issued a conservatory order that stays the implementation of the impeachment charges and the appointment of a replacement until October 24, 2024, when the matter will be revisited in court.

"The significance of issues raised in the petition and application certifies this matter as raising substantial questions of law and public interest and therefore fit to be heard by a bench of uneven number of judges to be appointed by the Hon. Chief Justice," the ruling stated.
Gachagua, through his counsel, filed a petition aimed at preventing President William Ruto from filling the Deputy President's position. He expressed concerns over the swift manner in which Parliament has sought to conclude the impeachment process and replace him, arguing that "there has been a demonstrated urgency to remove the Deputy President from office and install another person, which may be done hurriedly with a view to frustrating the Deputy President."
Moreover, Gachagua contended that he was denied the right to defend himself as the Senate rushed to conclude the proceedings before Thursday midnight, despite his hospitalization at the time.
The stay orders arrive on the heels of the National Assembly's unanimous approval of Interior CS Kithure Kindiki as Gachagua's potential replacement. However, with this new development, Kindiki's appointment and subsequent swearing-in will be put on hold until Gachagua's petition is thoroughly heard and determined.
As this legal battle unfolds, it raises broader questions about the political dynamics within the current administration and the implications for governance in Kenya. The outcome of Gachagua's petition could have far-reaching effects on the stability of President Ruto's government and the relationship between the executive and legislative branches.
