Cocorico Wines, Paris Lounge and Grill, Tessara Entertainment, and Trinity House International Ministry Ordered to Pay Mirema Residents KSh 5m over Noise Pollution

In a landmark ruling by the Environmental and Land Court (ELC), the serene neighborhood of Mirema in Kasarani has emerged victorious in a battle against noise pollution. Judge Oscar Angote presided over the case, delivering a verdict that resonated with the rights of the residents to a peaceful environment.


Cocorico Wines, Paris Lounge and Grill, Tessara Entertainment, and Trinity House International Ministry found themselves at the center of a legal storm as they were sued for disturbing the tranquility of Mirema with blaring music and disruptive noise. The residents had endured sleepless nights, their quality of life compromised by the relentless cacophony emanating from these establishments.


"The petitioner therefore seeks the intervention of this court to protect the right of its residents to a clean and healthy environment," emphasized the ruling, citing Article 42 of the Constitution, which enshrines every citizen's entitlement to such conditions. The court's decision underscored the paramount importance of safeguarding these fundamental rights, especially for the well-being of children growing up in Mirema Drive, as outlined in the Children’s Act.

Amani Residents Welfare Association/Mirema spearheaded the legal action, championing the cause of the community and demanding accountability from the entities responsible for the noise pollution. Their perseverance and determination have now borne fruit, with the court ordering the closure of the three nightclubs and the church found guilty of violating noise regulations.






Beyond the closure, a significant victory was secured in the form of compensation. The court awarded KSh 5 million to the affected residents, acknowledging the harm caused by the incessant noise pollution. This compensation serves not only as reparation for past disturbances but also as a deterrent for future transgressions, sending a clear message that the tranquility and well-being of communities cannot be sacrificed at the altar of commercial interests.


The ruling marks a significant milestone in the fight against noise pollution, setting a precedent for holding establishments accountable for their environmental impact. It underscores the importance of responsible business practices and the need for harmonious coexistence between commercial ventures and residential communities.
